Decree 59/2024/ND-CP amending Decree 34/2016/ND-CP … promulgating legal documents, including amending the provisions on the responsibility to solicit opinions on proposals for drafting legal documents as follows:

– The agency proposing to draft legal documents of central agencies shall solicit opinions from subjects directly affected by the policy in the proposal to draft legal documents, ministries, ministerial-level agencies, agencies under the Government, the Central Committee of the Vietnam Fatherland Front and relevant agencies and organizations; solicit opinions from the Vietnam Federation of Commerce and Industry on proposals to draft legal documents related to the rights and obligations of enterprises.

– The agency proposing to draft resolutions of provincial People’s Councils shall solicit opinions from subjects directly affected by the policy in the proposal to draft resolutions, specialized agencies under the provincial People’s Committees, provincial Vietnam Fatherland Front Committees and relevant agencies and organizations.

Regulations on intangible cultural heritage research
The content mentioned in Decree 39/2024/ND-CP stipulates measures to manage, protect and promote the value of intangible cultural heritage in UNESCO Lists and the National List of Intangible Cultural Heritage, including regulations on intangible cultural heritage research as follows:

– Research on intangible cultural heritage includes: research, identification of expressions, values, subjects, current status, transmission process, practice, creation, re-creation, social functions, influencing factors, protection measures and other contents to deepen the understanding of heritage and the management, protection and promotion of heritage values in life.

– Agencies and organizations with functions and expertise in conducting research on intangible cultural heritage must have the consent of the heritage subject and the heritage management agency in the area. Individuals conducting research on intangible cultural heritage must have the consent of the heritage subject and be legally responsible for their research.

– Research products and reports on intangible cultural heritage conducted by agencies and organizations must be accepted, widely announced to the heritage subject and included in the national database on cultural heritage.

– Research products and reports on intangible cultural heritage conducted by individuals can be digitized and included in the national database on cultural heritage.

Driving practice vehicle license and authority to issue Driving practice vehicle license
Decree 41/2024/ND-CP amends the Decree related to the management of automobile transportation activities, automobile driver training and driver testing services, including amending regulations related to Driving practice vehicle license and authority to issue Driving practice vehicle license.

– The Department of Transport issues Driving practice vehicle license to driving practice vehicles of training facilities managed by the locality according to the form prescribed in Form No. 01, Form No. 02 Appendix VII attached to Decree 41/2024/ND-CP; valid for the period of time allowed to circulate stated on the Certificate of technical safety inspection and environmental protection of motor vehicles but not exceeding the legal term of use for driving practice vehicles.

– The driving practice license is revoked in the following cases:

+ Issued to a driving practice vehicle that does not meet one of the conditions specified in Clause 2, Article 3 and Clause 2, Article 6 of Decree 65/2016/ND-CP;

+ Erased or modified;

+ Allowed for other organizations or individuals to use for the purpose of driving training;

+ The driving training facility is dissolved or has its training license revoked;

+ At the request of the training facility;

+ The driving practice vehicle is installed and uses 2 or more DAT devices to cheat during the driving practice training process.
