Land policies effective from April 2024
From On April 1, 2024, two provisions of the 2024 Land Law will come into effect, namely Article 190 and Article 248. For example, Article 190 of the 2024 Land Law stipulates sea reclamation activities as follows:

The State encourages organizations and individuals to use capital, techniques, and technology to carry out sea reclamation activities; there are policies to support and provide incentives for investors to carry out sea reclamation activities in accordance with the provisions of law.

Sea reclamation activities must comply with the following principles:

– Ensuring national defense, security, sovereignty, sovereign rights, jurisdiction, and national interests at sea; in accordance with the provisions of other relevant laws and international treaties to which the Socialist Republic of Vietnam is a member;

– Based on a full assessment of the economy, society, environment, ensuring sustainable development, biodiversity, natural factors, impacts of natural disasters, climate change and rising sea levels;

– In accordance with provincial planning or district-level land use planning or construction planning or urban planning;

– Exploiting and using marine resources effectively; ensuring harmony of interests between organizations and individuals carrying out sea encroachment activities and other related organizations and individuals; ensuring the right to access the sea of ​​people and communities;

– Sea encroachment activities must be established as an investment project or an item of an investment project in accordance with the provisions of law.

Financial policies effective from April 2024
Accordingly, the financial policies effective in April 2024 include:

Circular 13/2024/TT-BTC provides guidance on determining funding sources and making estimates, managing, using and settling funding for implementing the policy of streamlining the payroll, effective from April 15, 2024.

Funding sources for implementing the policy of streamlining the payroll for cadres, civil servants, and people working under indefinite-term labor contracts in administrative agencies are subject to the same regimes and policies as civil servants and non-professional workers at the commune level in Clauses 1 and 3, Article 2 of Decree 29/2023/ND-CP in agencies and organizations of the Party, the State, and socio-political organizations from the central to the commune level.

The budget for resolving the policy of streamlining the payroll is implemented as follows:

(1) For agencies and units that are implementing a special financial and income mechanism (in cases where the regulations on the special financial and income mechanism include the budget for implementing the policy of streamlining the payroll): Use the unit’s budget to implement the policies of streamlining the payroll according to the provisions of Decree 29/2023/ND-CP.

(2) For agencies and units that do not implement a special financial and income mechanism; Agencies and units implementing special financial and income mechanisms but in the special mechanism there are no regulations on expenditures for implementing the policy of streamlining the payroll:

– Agencies and units using the annual regular budget allocation (in addition to the state budget allocated to implement the policy of streamlining the payroll as prescribed in Point b of this Clause) to pay the following regimes:

+ One-time allowance equal to 03 months of current salary as prescribed in Point a, Clause 1, Article 6, Point a, Clause 1 and Point c, Clause 2, Article 7 of Decree 29/2023/ND-CP;

+ Support for paying social insurance and health insurance for those subject to streamlining the payroll within the prescribed age who wish to go to vocational training before settling the termination of employment as prescribed in Point a, Clause 2, Article 7 of Decree 29/2023/ND-CP;

+ Continue to pay the full salary during the vocational training period and subsidize the vocational training fee for the subjects as prescribed in Point a and Point b, Clause 2, Article 7 of Decree 29/2023/ND-CP;

– The State budget allocates funds to implement the remaining regimes (in addition to the regime at Point a of this Clause) in Articles 5, 6, 7, 8, and 9 of Decree 29/2023/ND-CP according to the following principles:

+ For cadres, civil servants, and people working under indefinite-term labor contracts in administrative agencies, the regimes and policies for civil servants as prescribed by the Government, belonging to or directly under ministries, ministerial-level agencies, and agencies under the Government, shall be applied.
